In North Carolina, you may be able to file a wrongful death lawsuit if you have lost a loved one due to another's negligence or intentional conduct. Punitive damages may be awarded in addition to compensatory damages in cases involving fraud, malice, or a complete disregard for the safety of others.
Punitive damages in North Carolina wrongful death lawsuits are capped at the greater of $250,000 or three times the compensatory damages awarded. A wrongful death claim must be filed within two years from the date of death.
