Failure to Appear and Failure to Comply

The most common and frequently misconstrued situations when it comes to Traffic Issues in North Carolina are the Failure to appear and Failure to Comply. The Failure to Appear also known as an FTA is entered when a person does not show up for court on the scheduled court date. The Failure to Comply also known as an FTC is entered when a person appears and is found responsible to an offense but then fails to pay the court cost for the infraction or ticket within 20 days of the court date.

Failure to Appear

In North Carolina if a person fails to appear or has an FTA for any traffic violation then it is reported to the county clerk of court where the ticket was obtained to the North Carolina DMV. After the DMV is notified of the person failure to appear, the DMV will send a letter indicating that if the traffic charge is not handled within 60 days then DMV will revoke their license privilege. Furthermore, 20 days after the Failure to Appear, the court clerk enters the failure to appear on the court system and consequently causes an admininistrative penalty of $200.00. This penalty is added to the court cost and fine that has already been issued through the court.

Unfortunatly, the failure to appear if you are an out-of-state driver could result in your inability to renew your license until the North Carolina ticket has been handled and the fees has been resolved.

Failure to Comply

Additionally, in North Carolina if a person fails to comply to pay the court cost of a ticket for 20 days after appearing for any traffic violation then that failure is reported by the county clerk of where the ticket was obtained to the DMV. After the DMV is notified of the person failure to comply, the DMV will send a letter indicating that if the charge is not paid within 60 days then the DMV will revoke their license privilege. Moreover, 20 days after the failure to comply, the court clerk notes the failure to comply in the system and consequently cases an administrative penalty of $50.00. This penalty is added to the court cost and fine that has already been issued through the court.
